Terms of service
These terms cover your use of the BandBox app for iPhone. By using BandBox you agree to them. If you don't, please don't use the app.
1. Who can use BandBox
BandBox is built for band directors and the staff and volunteers who help them. You must be 18 or older, or the age of majority where you live, to create an account. If you're between 13 and 18 and helping run a program, you may use BandBox only with permission from a parent or guardian and from the staff member responsible for the program. Students don't need accounts and shouldn't be given one just to be tracked.
2. Your account
You sign in with an emailed six-digit code, with Apple, or with Google. Keep access to that email account and that device secure; anyone who can receive your codes can reach your inventory. Tell us at julianmcg08@gmail.com if you think someone has got into your account.
3. Bands and shared access
An inventory belongs to a band, not to a person. Anyone who enters your band's six-character join code becomes a member and can see and change the whole inventory: adding items, signing gear in and out, printing labels, and deleting items. Only the director who created the band can invite, remove members, or generate a new join code.
Two consequences worth stating plainly. Sharing your join code is sharing your inventory — treat it accordingly. And because the band belongs to its creator, if the creator deletes their account, the band and its entire inventory are deleted for everyone in it.
4. Your content, and your responsibility for it
The inventory you type in is yours. We claim no ownership of it. You grant us only the permission needed to run the service: to store your content, transmit it between your devices, and display it to the other members of your band.
You are responsible for having the right to enter the information you enter. That includes student names. If your school, district, or employer has rules about putting student information into third-party software, or if laws such as FERPA apply to your program, complying with them is your responsibility, not ours — we have no relationship with your school unless we've signed something with them. Please don't enter information you don't need.
You agree not to use BandBox to store unlawful content, to try to reach another band's data, to disrupt or reverse-engineer the service, or to use it in a way that breaks the law where you are.
5. What BandBox costs
BandBox is currently free, with no in-app purchases and no advertising. If we ever introduce a paid feature, we'll say so clearly before you're charged, and nothing you've already got will start costing money without notice.
6. What BandBox is not
BandBox is a convenience tool for keeping track of school-owned instruments and uniforms. It is not an official record, an accounting system, an audit trail, or evidence for an insurance claim or a legal dispute. Specifically:
- Syncing happens while the app is open, roughly every thirty seconds. It is not instantaneous.
- If two people edit the same item at nearly the same moment, the later edit wins and the earlier one is lost. There is no merge and no warning.
- Data on a single device can be lost like any other app data — a broken phone, a failed restore, a deletion.
Keep your own records of anything that matters financially or legally.
7. Availability
We'll try to keep BandBox working, but we don't promise it will always be available, and we may change, suspend, or discontinue features. If we ever discontinue the service outright, we'll give you notice in the app and a reasonable chance to export your data first.
8. Third-party services
BandBox depends on Supabase for hosting and sign-in and on Apple and Google for the sign-in buttons you choose to use. Their terms and outages are outside our control.
9. Ending it
You can stop at any time by deleting your account in Settings, which is also how you delete your data. We may suspend or end an account that breaks these terms or that we're required to act on legally; where it's practical and lawful, we'll tell you first.
10. Disclaimer of warranties
BandBox is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data will never be lost. Some jurisdictions don't allow these exclusions, in which case they apply to you only as far as the law allows.
11. Limitation of liability
To the fullest extent permitted by law, we won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost instruments, lost profits, or the cost of replacing anything, arising out of your use of BandBox. Our total liability for any claim relating to BandBox is limited to the greater of the amount you paid us for it in the twelve months before the claim, or fifty US dollars. This limitation applies even if we've been told the damage was possible.
12. Indemnity
You agree to cover us against claims arising from information you entered into BandBox that you didn't have the right to enter, or from your use of the app in breach of these terms.
13. Changes
We may update these terms. If a change matters, we'll update the date above and tell you in the app. Continuing to use BandBox after a change means you accept the new terms.
14. Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Disputes will be heard in the courts located there, and we each consent to that. Nothing here takes away rights you have under mandatory consumer-protection law where you live.
15. About the App Store
If you got BandBox from Apple's App Store, then: this agreement is between you and us, not Apple; Apple has no obligation to provide any support for BandBox; Apple isn't responsible for any claim about the app, including product liability, legal compliance, or intellectual-property claims; and Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you. Your use is also subject to Apple's own App Store terms, and you confirm you're not located in a country subject to a US embargo or on a US prohibited-parties list.
